These Terms govern HostMamma-controlled websites, inquiries, and direct expert services. Provider-fulfilled products are governed by the HostMamma Universal Terms of Service and applicable agreements presented during account creation and checkout.

1. Acceptance and eligibility

By using HostMamma.com, requesting services, or accepting a proposal, you agree to the terms that apply to that activity. Services are intended for business and professional customers who are at least 18 and able to enter a binding agreement. A person acting for an organization represents that they have authority to bind it.

2. Accounts and security

You are responsible for accurate account information, authorized users, credentials, and activity under your account. Notify the applicable support team promptly if you suspect unauthorized access. Provider accounts are administered under the provider agreements linked below.

3. Provider-fulfilled products

Product availability, features, prices, introductory periods, renewal prices, taxes, billing cadence, registry rules, and cancellation terms are those shown for the customer’s market and product at checkout. The applicable provider Universal Terms and product-specific agreements control those products.

4. Direct expert services

Custom websites, applications, creative, marketing, migration, management, and consulting services may require a proposal, statement of work, order form, or service agreement. That document controls its scope, schedule, fees, assumptions, acceptance process, ownership, licenses, support, and termination terms.

5. Customer responsibilities

You must provide timely, accurate information and materials; obtain necessary rights and permissions; maintain lawful backups where applicable; protect credentials; review deliverables; and use services in compliance with law and the Acceptable Use Policy.

6. Customer content

You retain ownership of content you provide. You grant HostMamma and its providers limited permission to perform requested work. You represent that you have the rights and lawful basis needed for submitted content, data, credentials, and instructions.

7. Intellectual property

HostMamma and its licensors retain rights in their brands, software, templates, processes, systems, and pre-existing materials. Rights in custom deliverables are determined by the applicable project agreement.

8. Service availability

Online services may be changed, interrupted, or discontinued. Any specific uptime, response-time, maintenance, or service-credit commitment applies only when included in a written agreement.

9. Disclaimers

To the fullest extent permitted by law, HostMamma-controlled websites and general informational materials are provided “as is” and “as available.” HostMamma does not guarantee that every recommendation, estimate, search result, third-party product, or online service will be uninterrupted, error-free, or suitable for every purpose. Rights that cannot lawfully be excluded remain unaffected.

10. Limitation of liability

To the fullest extent permitted by law, HostMamma is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, business opportunity, goodwill, or data, arising from HostMamma-controlled websites or services. A different limitation in a provider agreement or signed project agreement controls for that product or project.

11. Suspension and termination

HostMamma may restrict or terminate access for nonpayment, unlawful activity, security risk, material breach, or harm to customers, systems, or third parties. Data access, fees due, refunds, and surviving obligations are governed by the applicable provider or project agreement.

12. Governing terms and changes

Provider agreements govern provider-fulfilled products. Signed project agreements govern direct expert services. These general Terms supplement those agreements. HostMamma may update these Terms by posting a revised version with a new effective date.

Provider-fulfilled products

Domains, hosting, email, security, and related products fulfilled through the upstream product-provider storefront are governed by the current agreements presented for the customer’s market, product, account, and checkout. Those provider agreements control for provider-fulfilled products if they conflict with a general summary on HostMamma.com.
